Terms & Conditions

These Terms & Conditions govern your access to and use of TributeHarbor, including memorial pages, memorial requests, condolence messages, digital tribute features and related services.

Effective Date: 25 August 2026
Please read these Terms carefully. By accessing or using TributeHarbor, submitting a memorial request, posting content, sending a condolence message or using any TributeHarbor service, you agree to these Terms to the extent applicable to your use of the platform.

1. About TributeHarbor

TributeHarbor is a digital condolence and memorial platform based in Penang, Malaysia.

TributeHarbor is designed to help families, relatives, friends and funeral service providers:

  • Create and maintain digital memorial pages
  • Share funeral information
  • Provide livestream links where available
  • Receive and display condolence messages
  • Share memorial links and QR codes
  • Offer digital tribute features where available
  • Facilitate family-support features where available

TributeHarbor is not a funeral home, religious organization, medical provider, legal adviser or financial institution.

2. Pilot-Stage Services

TributeHarbor is currently being developed and introduced through an early-stage pilot.

Certain features shown on the website may be:

  • Available only to selected users or funeral service providers
  • Manually administered during the pilot
  • Subject to change, testing or temporary suspension
  • Unavailable in certain locations
  • Introduced at a later stage

Sample memorials and demonstration features are provided for illustration and do not necessarily represent a live commercial transaction.

3. Eligibility and Authority

You must have the legal capacity to use TributeHarbor and agree to these Terms.

If you submit a memorial request, you confirm that:

  • You are a family member, authorized representative, funeral service provider or other person with appropriate authority.
  • You have permission to provide the information and photographs you submit.
  • The information supplied is accurate to the best of your knowledge.
  • Your submission does not intentionally violate the rights of another person.

4. Memorial Requests

Submission of a memorial request does not guarantee that TributeHarbor will publish the memorial.

TributeHarbor may:

  • Request additional information
  • Verify details with a family representative
  • Contact the funeral service provider
  • Delay publication while verification is taking place
  • Decline a request that cannot reasonably be verified
  • Reject content that violates these Terms

TributeHarbor may also remove or restrict a memorial if credible concerns arise regarding authorization, accuracy, fraud, family disputes or unlawful content.

5. Memorial Information

Memorial information may include:

  • Name of the deceased
  • Photographs
  • Birth and passing dates
  • Funeral dates and locations
  • Life story or obituary
  • Livestream links
  • Condolence messages
  • Other approved memorial content

The person submitting information is responsible for ensuring that they are authorized to provide it.

6. Accuracy of Funeral Information

TributeHarbor relies on information supplied by families, funeral service providers and authorized representatives.

Although we may review information, TributeHarbor does not independently guarantee the accuracy of:

  • Funeral dates
  • Funeral times
  • Venue information
  • Livestream availability
  • Directions
  • Service arrangements

Important

Visitors should confirm time-sensitive funeral information with the family or funeral service provider where necessary.

7. Condolence Messages and User Content

Users may be permitted to submit condolence messages, memories or other content.

You agree not to submit content that is:

  • Abusive, threatening or harassing
  • Defamatory or intentionally false
  • Obscene or sexually explicit
  • Hateful or discriminatory
  • Fraudulent or misleading
  • Commercial spam or unauthorized advertising
  • Invasive of another person's privacy
  • Infringing intellectual-property rights
  • Otherwise unlawful

TributeHarbor may moderate, hide or remove content that violates these Terms or is reasonably considered inappropriate for a memorial environment.

8. License to Display Submitted Content

You retain ownership of content that you lawfully own.

By submitting content for publication on TributeHarbor, you grant TributeHarbor a non-exclusive, royalty-free license to host, reproduce, format and display that content only as reasonably necessary to operate, maintain, share and provide the relevant memorial or TributeHarbor service.

This license does not transfer ownership of your content to TributeHarbor.

9. Family Requests, Corrections and Disputes

An authorized family representative may request corrections, updates or removal of memorial content.

TributeHarbor may request evidence reasonably necessary to verify the requester's identity and authority.

Where conflicting instructions are received from different family members or representatives, TributeHarbor may temporarily restrict, suspend or leave unchanged the disputed content while the matter is reviewed.

TributeHarbor is not responsible for resolving private family disputes and may require affected parties to resolve such disputes independently.

10. Digital Tributes

TributeHarbor may offer symbolic digital tribute options, such as digital flowers, memorial candles or condolence gifts.

Digital tributes are symbolic digital expressions of condolence unless the relevant page clearly states otherwise.

Purchasing or sending a digital tribute does not mean TributeHarbor will deliver a physical flower, wreath or other physical item unless the specific service expressly states that physical delivery is included.

11. Payments and Family Support

Certain TributeHarbor payment features may not yet be active.

Where digital tribute payments or family-support transactions are introduced:

  • The applicable amount and any fees should be displayed before payment.
  • Transactions may be processed by an approved third-party payment provider.
  • Additional payment-provider terms may apply.
  • Family-support recipients may be required to complete identity or account verification.
  • TributeHarbor may suspend payment functionality if fraud, unauthorized fundraising or verification concerns arise.

Additional rules relating to payments, refunds and transaction disputes may be set out in the TributeHarbor Payment & Refund Policy.

12. Funeral Service Providers

TributeHarbor may work with independent funeral homes, undertakers and other funeral service providers.

Unless expressly stated otherwise:

  • Funeral service providers remain independent businesses
  • They are responsible for their own funeral services
  • They are responsible for their own pricing and service quality
  • TributeHarbor does not control their physical funeral operations

A “Verified Memorial” or funeral-provider identification means that TributeHarbor has obtained an appropriate level of confirmation for the memorial. It does not represent an unconditional guarantee or endorsement of every service provided by that funeral business.

13. Third-Party Services

TributeHarbor may provide links or integrations involving:

  • Google Maps
  • Livestream providers
  • Social media platforms
  • Payment providers
  • Funeral-home websites
  • Other third-party services

Those services are operated independently and may have their own terms, policies, availability and technical requirements.

TributeHarbor is not responsible for independent third-party services except to the extent required by applicable law.

  • Incorrect information supplied by third parties
  • Changes to funeral arrangements not communicated to us
  • Failure of external livestream services
  • Failure of third-party payment or mapping services
  • Unauthorized actions by users despite reasonable safeguards
  • Events outside TributeHarbor's reasonable control

Nothing in these Terms excludes or limits any liability, consumer right or remedy that cannot lawfully be excluded or limited under applicable law.

19. Responsibility for Your Conduct

You are responsible for information and content you submit, your use of TributeHarbor and any violation of these Terms.

Where permitted by law, you may be responsible for reasonable losses or claims caused by your fraudulent, unlawful or unauthorized use of TributeHarbor.

20. Suspension or Termination

Any dispute relating to these Terms or the use of TributeHarbor will be handled in accordance with applicable Malaysian law and the jurisdiction of the appropriate Malaysian courts, subject to any mandatory consumer or statutory rights.

24. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
